Hemp Under Fire: Congress Moves to Ban Popular Hemp Products

The House Appropriations Committee, led by Rep. Andy Harris (R‑MD), introduced language that would redefine “hemp” under federal law, banning products with any “quantifiable amount” of THC or similar cannabinoids.

Let’s be clear:
This isn’t just targeting intoxicating compounds like delta-8. If passed as written, it could ban CBD oils, tinctures, full-spectrum gummies, THCa flower, and other trace-THC products—even if they comply with the 0.3% THC limit required by law at the time of harvest.

A Confusing “Fix”

After pushback, the committee added report text to clarify that the ban isn’t meant to target non-intoxicating or industrial hemp. But that “clarity” isn’t written into the actual bill—so legally, it’s still wide open to interpretation.
